Write a report for him explaining What steps he needs to take to ensure that the standard terms are in fact part of any contract he makes with a customer The extent to which he is free to include any term he wants in his standard terms and The provisions of contract law about termination and breach of contract which he may wish to take into account when drafting his standard terms. Background: In order for the customer and XYZ to be bound by standard terms and conditions there should be a set of criterion filled. These conditions should be treated as exclusion clauses as they are the extreme conditions to be enforced. For these standard terms and conditions to be enforced there needs to be a valid contract, which means that four requirements have to be fulfilled. A valid contract must have the following elements; offer; acceptance; consideration; capacity; and intention. These are present in this contract when XYZ offers his work and the customer accepts verbally or in writing. There is also intention because there is an understanding that XYZ will turn up to work on a certain day and the customer will pay a certain fee, which is evidence of consideration as the customer is at a disadvantage.This is a valid contract, however the next area to explore is whether the exclusion clause and standard terms apply because the customer has never worked with XYZ and at the verbal con tract point does not indicate what his usual terms and conditions are. Basic Requirements of Ensuring Enforceable Standard Terms and Conditions: Under contract law there are only three ways that they can be incorporated which are: By signature even if they are not read; By notice where there has to be sufficient notice By custom where there have been previous dealings between the parties even if the clause is added in later. In every case XYZ should ensure that there is case is a signature in case there is no indication of previous dealings, hence the customer may not bound by these conditions yet. Therefore one has to consider the case of notice, off hand there is no notice as XYZ fully indicates what these conditions   and the question is whether the average person would have notice, especially as XYZ is an builder and the customer as a business and these could be construed as standard conditions in the business; but this would be easy to prove as notice was given due to XYZ giving these terms and conditions before the contract was agreed and giving a good indication of their nature at this level. Unenforceable Standard Terms and Conditions In every case that a signature is required it gives rise to the opportunity where the terms were fully expressed but under contract law there could be one problem with the contract if the customer has received the contract in their hands and failed to read it the case of Alderslade v Hendon Laundry Ltd if the exclusion clause can only be construed in negligence and in certain circumstances then it is applicable and as The customer received the usual terms and conditions before XYZ started the work, i.e. they had a chance to end the contract then they are bound by them. Therefore it is still very confusing whether XYZ is excluded from the damages that the customer is seeking, therefore the statutory provisions of the UCTA and Sale and Supply of Services Act 1982 (SGSA). Is XYZ is liable for the damages that a customer may ask for? In response there is little evidence in whether the exclusion clauses should be supported or not. Under UCTA Section 2 it holds that negligence cannot be excluded in respect to personal and/or death bat all. In relation to other loss/damage liability cannot be excluded unless there is reasonable notice. Section 11 holds that the reasonable test is that the term is fair and reasonable and whether the individual should have reasonably known or in contemplation of when the contract was made. This is similar to the case law discussion; however it is written from the point that negligence can not be excluded except in strict circumstances. There was no real notice in this case, especially when the verbal contract was made. Therefore it is very likely that this clause will not be upheld as the case of Andrews Bros (Bournemouth) Ltd v Singer and Co Ltd holds that exclusion clauses against the party seeking to rely on them. Yet in relation to the damages to the customer it has to be determined if there is remoteness of damage, whereby monetary compensation can be claimed for a failure to perform a primary obligation as this is a breach and/or the loss for any breach of a secondary obligation. In respect to the negligence that has caused personal injury to persons the law states that this cannot be excluded under Section 1(2) of the UCTA, therefore it has been shown that the customer may claim for this. Reasonableness Test, Breach and Questionable Standard Terms and Conditions Again we must turn to whether there is reasonable notice to exclude liability and under the SGSA Section 16 where restricting liability for breach of implied terms arising from Sections 13-15 is subject to the reasonable test and provisions of the UCTA, where the reasonableness test is based upon the common law officious bystander test that is defined in Sir Law v Southern Foundries Ltd which is a stricter test for exclusion clauses where it has to be so reasonable and that the notice is sufficient that the officious bystander would agree to its terms. This basically holds that there are implied terms such as a reasonable quality of goods and services and that it should be completed in a reasonable quality and should be usable. This means that the exclusion of liability for faulty equipment and liability for faulty work cannot be excluded. This means that these two exclusion clauses cannot be upheld. In respect to the negligent completion of work i.e. was there reasonable excuse for the negligence. Yet it was an express term of the contract and without reasonable excuse this exclusion clause it is possibly not going to be upheld, this is rule from an early common law principle. Yet there is the question whether this is reasonable exclusion for the trade.   However, as in the case of Edmund Murray Ltd v BSP International Foundations Ltd it was held that it was not fair and reasonable for the party in breach to rely on an exclusion clause for failing to meet the specifications of the other party. Therefore this again will be subject to the reasonableness test where the test applied to the whole term and to the particular reliance on it. Therefore if it is a specific term of the contract to be finished by the certain date and made clear by The customer and XYZ did this as it was then it is very likely it can be excluded because it is a trade standard. Finally, if one considers the Unfair Terms in Consumer Contracts Regulations 1999 (UTCCR) if the term does not create an unfair balance in detriment to the consumer it can be upheld. Yet as this does create an unfair balance and puts the customer at a loss then they will be protected from the exclusion clause as a consumer, even though she is acting for her business. However are the circumst ances of this variation sufficient enough for the customer to claim? Therefore is there a reasonable excuse for the variation and did both the customer and XYZ have equal bargaining power? The first question to ask is whether the circumstances that lead to the variation of the contract would have frustrated the contract, if the variation is perfectly acceptable as long as the customer was not put under duress to accept the new terms. The Lilith in Dracula, Carmilla, Christabel, Geraldine and The Hunger For centuries Lilith, the Queen of the Night, has been blamed when a child or man dies without certain cause or when a woman refuses to be submissive to her husband.   While the Legend of Lilith is not widely known today, it is not difficult to find information about the demoness. However, there are slight variations found from story to story.   Here we will focus on the myth as found in Hebrew mythology, and we will particularly emphasize the similarities seen between Lilith and various vampires seen in literature today.   The Hebrew figure of Lilith was actually borrowed from Babylonian and Syrian myths.   Lilitu was a Babylonian demon and a spirit of the night and of storms.   Lamassu was a Sumerian goddess and the daughter of Anu, the god of Heaven.   It is believed that Lilith is a combination of these two demons from earlier legends.   However, for the purpose of our study, we will focus on the legend of Lilith found in Hebrew scriptures.   According to Hebrew scriptures, Lilith was Eve’s predecessor and therefore, the first wife of Adam. But why are American ghettos filled with so much violence, drugs, and inopportunity? In John Singleton’s powerful drama Boyz N the Hood the harsh reality of youths growing up in South Central Los Angeles, a place where drive-by shootings and unemployment are rampant, is brought to life. Shot entirely on location in South Central LA, Boyz N the Hood presents its story with maximum honesty and realism. The movie is a prime example of how American ghettos are dead end environments with minute chances for survival. If we are to put an end to the destitute, prison-like ghetto environments, we first need to take a look at what goes on there.   Ã‚  Ã‚  Ã‚  Ã‚  One can point to many initiating factors from racism to property owner’s aspirations of gentrification that create ghettos. Furious Styles, the strong and intelligent father of the film’s main character Tre, addresses the issue of why these areas are in such a dire state when he says: [†¦] How do you think the crack rock gets into the country we [black people] don’t own any planes, we don’t own no ships†¦we are not the people who are flyin’ and floatin’ that shit in here [†¦] why is it that there a gun shop on almost every corner in this community? [†¦] For the same reason that there’s a liquor store on almost every corner in the Black community, [†¦] they want us to kill ourselves. You go out to Beverly Hills you don’t see that shit, the best way you can destroy a people is if you take away their ability reproduce themselves. (Singleton) In this passage, Furious presents ideas of white property holders looking for the best way to exterminate the Black and Hispanic communities in their area. The late rapper Tupac Shakur once declared, â€Å"We [Black people] ain’t meant to survive cuz it’s a set up† (Shakur, Keep Ya Head Up). As far-fetched as these notions may seem, they may hold more truth than one thinks. Questions arise as to the relation between the ghetto and the upper class areas. Oddly, these communities, though only miles apart, are completely detached. In a study on ghettos in America, Ed Glaeser writes that: These districts commonly called ‘gh... ...r any other sport after college, is slim to none. At the very least, more high profile avenues out of the ghetto such as science and the arts need to be instituted in order to provide better opportunity for the futures of ghetto youths. The impact of family and neighbourhood on the academic achievement among African American teenagers

1.0 Introduction Performance in school has for many years been closely attributed to an individual’s life chances. As the need for an individual to undergo advanced level of training to be able to sustain basic living become a necessity, the consequence of difficulty in schooling have become imperative (Leventhal & Brooks-Gunn, 2000). However, individuals do not attend schools in a vacuum as they come from families, neighbourhoods, and various life events that generally impact on their performance in one way, or another. Currently, almost half of the school going teenagers are coloured. Over 70 percent of residents in large cities in the United States are also coloured (Williams et al., 2002). Based on this statistics it is important to understand the specific aspects of academic development of coloured people in the United States.According to ecological theory, the environment has a great influence on the development of adolescents (Steinberg, 2001; Ingoldsby & Shaw, 2002). As much as the adolescents make their own behavioural choices, societal structures and interpersonal relationships are viewed as imperative aspects that shape the adolescent choices (Leventhal & Brooks-Gunn, 2000). Adolescents growing up in the 21st century look beyond their parents and siblings for developmental support. Therefore, the concept of neighbourhood comes in when analysing the development of adolescents. The neighbourhood concept in this context refers to both home and school neighbourhood and how it interacts with th e teenager. 2.0 Problem Definition The issue of educational achievement gap has been documented by various studies (Gutman et al., 2002; Rankin & Quane, 2002). Unfortunately, most of these studies indicate that African American learners have the lowest educational standards in the United States (Moore & Chase?Lansdale, 2001). Empirical evidences indicate that in comparison to their white counterparts, the performance of African American children is below the normal standards (Leventhal & Brooks-Gunn, 2000). Many African American learners come from families that are not only economically unstable but also socially underserved. Several reasons have been linked to the poor academic performance of African American teenagers which eventually results to high rates of school dropout. Common issues that these teenagers face include racism, poverty, and violence (Brody et al., 2001). These issues affect their emotional and academic performance. Due to their poverty ridden home settings and surrounding, African American teenage rs fail to establish a link between academic excellence and better adult life (Moore & Chase?Lansdale, 2001). The teenagers are also aware of the stereotypic approach linked to their race which affects their self-concept and ultimately educational performance (Gutman et al., 2002). Consequently, it is important to establish family and neighbourhood factors and how they impact on the academic performance of African American teenagers. This position is vital in the context that the current understanding on the issue is limited and does not consider the modern-day neighbourhood concept, where the United States has embraced mixed racial neighbourhood settings in most places where African Americans reside. More so, most African Americans live in big cities, which expose them to multiracial settings that may affect academic performance of the teenagers. Specifically, it is important to analyse how parents, peers, close friends, classmates, and teachers influence the performance of the African American teenagers. 3.0 Research Aim and Objectives To fully explore this research issue, the following objectives will guide this study: To investigate the links between family settings and academic achievement of the African American teenagers To examine how school and home neighbourhoods influences academic achievement among African American adolescents To devise a way forward regarding family and neighbourhood in managing the poor academic performance among African American teenagers 4.0 Literature Review Various factors have been linked to poor academic performance among students. A study by Leventhal and Brooks-Gunn, (2000) identified variables within a culture, a family, and the environment to greatly influence the academic achievement of learners as compared to the type of an educational program. The roles of social and individual support in education are influential in the academic achievement outcomes. The school environment communicates to the learners on how the school perceives them (Brody et al., 2001). A school that is known to promote collegiality, respect and values has students that are positively inclined to better performance (Gutman et al., 2002). African American learners record high levels of school drop-outs due to the possibility that the school environment does not support their needs. Consequently, the school setting as a learner’s neighbourhood influences the academic achievement of the learners (Rankin & Quane, 2002). Studies have also suggested the existence of other various factors that influence the academic achievement of the learners other than the school curriculum (Ingoldsby & Shaw, 2002). It is essential to understand how these other factors affect the African American adolescent especially those that are facing academic hurdles. Peers have been identified to determine the teenagers’ deposition towards their learning institutions (Brody et al., 2001). The fact that African Americans generally have a problem with academic performance the role of peers may in most cases be negative as far as academic performance is concerned. For instance, studies have shown that the mere lack of approval from peers is substantive enough to negatively influence the academic achievement of the adolescents (Williams et al., 2002). Furthermore, numerous studies identify parenting as a central player in academic performance of teenagers (Leventhal & Brooks-Gunn, 2000; Gutman et al., 2002). Parents that have supportive association with their teenagers tend to promote a sense of autonomy among the teenagers which allows the teenagers to not only explore their environment but also seek parental emotional support (Steinberg, 2001). Studies have also shown that the role of parent in defining the emotional and academic performance of the teenagers is greater among the minorities in the United States (Moore & Chase?Lansdale, 2001). Another issue that was identified in the literature review as an influential factor for academic permanence among teenagers was the social support. Specifically, social support was closely linked to school retention levels for adolescents (Brody et al., 2001). Specifically four social factors are known to influence the academic performance of African American teenagers, namely neighbourhood, peers, parents, and the school (Williams et al., 2002). This clearly indicates that there is a link between the research issues and the academic performance of African American teenagers. This study will try to provide an in-depth analysis of existing information on the research issue in an attempt to establish a gap of knowledge that the study will attempt to seek. Specifically current literature links family and neighbourhood to performance, but it does not provide the exact family and neighbourhood factors that have resulted to poor academic achievement among African American this will be the area of interest for this study. To be able to establish a comprehensive investigation into the research issue, it will be important to provide an overview of the general research plan that will be adopted 5.0 Research Plan 6.0 General methodology To conduct the research successfully, it is vital to develop and abide by a working methodology to ensure the outcomes are worthwhile (Creswell, 2003). This research is an analytic in nature as it will involve the analysis of the existing situation of academic performance of African American teenagers relative to their homes as well as neighbourhoods. This will ultimately allow the investigator to draw conclusions based on these analyses pertaining to how much homes and neighbourhoods influence the academic performance of teenage African Americans. The research methodology that will be used will blend quantitative and qualitative research methods as summarized below:Literature ReviewThe literature review will offer an overview of the research topic at hand using data collected from articles, journals and books. A literature review will be important in the comprehension of the background of the topic (Creswell, 2003). It will also serve as a base in aiding the methods employed in the research. Specifically, this will involve examining articles, books and any other literature that has already been published on the research issueSurveysSince the research issue involves analysing the public opinions, which is vast, survey is an appropriate method for collecting quantitative data (Creswell, 2003). This will be done through creating questionnaires. The questionnaires will then be used for collecting numerical data from the participants. The questionnaire will also contain a section that will be used for the collection of demographic data from the participants.InterviewsTo further enhance the effectiveness of the analysis, interviews of a selected few people will be conducted in order to provide qualitative data for analysis. Interviews, unlike surveys require a lot of time but provide more in depth data founded on opinions and hence assist in uncovering specific information relevant to the research issue (Creswell, 2003). Semi structured interviews will be conducted to collective subjective views of the study participants on the research issue. A combination of qualitative and quantitative data collection methods will be necessary to provide enough data needed for the analysis to ensure the study arrives at a well informed conclusion. Consequently, combining all the data uncovered through the above methods, a data analysis will follow. This will be implemented through vigilant assessment of qualitative and quantitative data in order to reach an acceptable conclusion.
